Article 1 –General Agreement
1.1 The Agent shall recruit and supply competent Indonesian Drilling and Catering crew
(Hereinafter referred to as Crew) to the Principal in compliance with the request of the
Principal
1.2 This Manpower Supply Agreement is to crew up to 3 Onshore Drilling Rigs in Basra for
International Rig and Oilfield Services Limited. Hereinafter referred to as the Client
Article 2 - Qualification of Crew
2.1 The Agent shall evaluate and screen crew members so as to ensure that those who are
employed by the Agent on behalf of the Principal are fully qualified, competent and licensed
for the required service.
2.2 The Agent shall ensure that the full set of certificates shall be presented with the valid period
no shorter than the period of contract, and the Endorsement Certificates shall be genuine
and valid.
2.3 The Agent shall provide with the personal records of all licensees crew, a crew list and other
document which may required by the Principal.
2.4 The Agent shall ensure the crew to be able to write, read and communicate with English and
to be satisfied with the rank-wise standard of the Principal.
2.5 The Agent shall provide crew in accordance to the requirements specified in Appendix 1
Article 3 - Change of Crew
3.1 The Principal reserves the right to demand replacement of any crew member that is
extremely unfit for his duty. The Agent, on receiving the complain, shall arrange for such
replacement timely, however on one weeks advance notice from the Principal shall be
required.
3.2 A Crew replacement can also be requested should the Client find that the crew is not up to
required standard in the discharge of his/her duties
Article 4 – Crew Traveling
4.1 The Crew will be provided with transportation from the hiring base (home base at the point
of hire) to the location of the rig. If mode of transport is airline travel, employee will be
provided with economy airfare
Article 5 – Crew Work Schedule
5.1 The Crew’s work duration will be for a continuous period of 3 months in accordance to the
work schedule provided
5.2 On completion of each work period (referred to above) the Crew will be entitled to one
month off days which includes traveling days to and from the Rig
5.3 The Crew will be required to make themselves available to return from their field break
within 24 hour notice to resume duties, should the designated Company Officer require to do
so. Disciplinary action will be taken for those who do not adhere to this requirement
5.4 The crew will be required to stay back in the event of a “no show” of their relief or any other
unforeseen circumstances.
5.5 The crew will be required to work 12 hours shift daily with consideration for reasonable
length of time given meals and breaks while on duty
5.5 The Crew are required to be on duty on rest days and public holidays, should these days fall
within the scheduled work days. There will be no additional or overtime pay on those rest
days and public holidays that falls on the scheduled work days
Article 6 – Crew Remuneration
6.1 The Principal agrees to pay the Agent as per the rates outlined in the budget column of
Appendix 1
6.2 Remuneration will only commence once the Crew have reached the job site in Basra and
commenced the work schedule
6.3 The Principal will pay the Agent at the end of each month. The Principal will only make
payment once sufficient funds for Crew remuneration are made available to the Principal by
the Client
6.4 The Agent shall assist the Crew in the regular remittance of their monthly salary to his/her
designated beneficiaries through normal channels
Article 7 – Medical & Insurance
7.1 The Crew will be covered under the Client’s Group Insurance scheme. The Agent may choose
to take out a local Indonesian Insurance scheme to cover the crew supplied under this
agreement. This will either be under the expense of the Agent or the Client
Article 8 - Personal Protection Equipment (PPE)
8.1 The Crew will be provided with coveralls (2 Pairs), Safety Boots (1 Pair) and where
appropriate a safety helmet to be used at the job site
8.2 When leaving the job site the Crew must surrender this equipment to the designated officer
of the Client at the job site in Basra
Article 9 – Termination of Agreement
9.1 This Agreement shall be terminated at once or within a certain period with written notice
(stipulating the reason of Force Major) in case of war, natural disaster, civil insurrection,
governmental or other official limitation leading to the failure of performance of this
Agreement.
9.2 Either party may terminate this Agreement at any time for any reason by giving thirty (30)
days prior notice in writing.
Article 10 - Law and Arbitration
Any dispute or difference of opinion under this Agreement shall be settled between the Principal
and the Agent with mutual cooperation and in good faith.
In witness of the foregoing, two copies of this Agreement shall be signed by both parties concerned
and both parties shall retain one copy each.
